These Terms of Service govern your use of the SwimEcho website and your purchase of products or services from SwimEcho (“SwimEcho”, “we”, “us” or “our”).

By accessing our website, placing an order or using our services, you agree to these Terms of Service.

Online Store Terms

You may use our website and products only for lawful purposes.

By placing an order, you confirm that the information you provide is accurate, complete and up to date.

We reserve the right to refuse or cancel an order where reasonably necessary, including where a product is unavailable, pricing information is incorrect, payment cannot be authorised or we suspect fraudulent activity.

Products and Services

We aim to provide accurate product descriptions, images and specifications. However, colours, packaging, accessories and minor product details may vary slightly from those shown on our website.

We may update or discontinue products, specifications or services from time to time without prior notice.

Prices and Payment

Prices are shown on our website and may change from time to time.

For website orders, the final amount payable, including any applicable delivery charges, discounts or taxes, will be shown at checkout before you complete your purchase.

For separately arranged Business & Team Orders, the total amount payable and any applicable delivery charges will be confirmed before payment.

Website orders must normally be paid using one of the payment methods available at checkout.

For eligible Business & Team Orders, bank transfer may be arranged separately by contacting SwimEcho. Orders paid by bank transfer will normally be processed after cleared payment has been received, unless otherwise agreed in writing.

Orders

Your order is subject to acceptance and product availability.

If we are unable to fulfil your order after payment has been received, we will contact you and arrange an appropriate refund.

Shipping and Delivery

Shipping options, delivery charges and estimated delivery times are set out on our website, at checkout and in our Shipping Policy.

Customers are responsible for providing complete and accurate delivery information.

Delivery times are estimates unless expressly stated otherwise.

Returns, Refunds and Cancellations

Returns, refunds, exchanges, cancellations and warranty claims are handled in accordance with our Sales, Warranty & Refund Policy.

Nothing in these Terms affects your statutory rights under applicable consumer law.

Warranty

SwimEcho products may be covered by a limited warranty against manufacturing defects, subject to the conditions set out in our Sales, Warranty & Refund Policy.

The warranty does not normally cover damage caused by misuse, accidental damage, unauthorised repair or modification, improper storage, normal wear and tear, or use outside the stated product specifications.

Product Use and Underwater Use

You are responsible for reading and following all instructions, warnings, maintenance guidance and safety information supplied with the product.

Products designed for swimming or underwater use must be used within their stated waterproof rating, operating limits and intended conditions.

Damage caused by misuse, exceeding stated depth or operating limits, improper charging, incorrect care or failure to follow product instructions may not be covered by the warranty.

SwimEcho products are not medical devices unless expressly stated otherwise.

Promotions and Discount Codes

Promotional offers and discount codes may be subject to additional conditions, including expiry dates, minimum order values, product restrictions or usage limits.

Unless otherwise stated, promotional codes cannot be exchanged for cash or combined with other offers.

Business & Team Orders

We welcome orders and enquiries from UK swim coaches, swim schools, clubs, teams and other organisations.

There is no separate minimum order quantity for standard Business & Team Orders. One Transmitter + One Headset is the standard starting setup.

Team pricing may be available for selected multi-swimmer configurations, including 1+3 and 1+5 setups. Requirements for 1+10 or larger configurations may be quoted separately.

Eligible UK swim coaches, swim schools and clubs may apply for the SwimEcho Coach Trial Programme. Complimentary trials are subject to availability, suitability and approval by SwimEcho. Any trial-specific conditions will be provided before the trial begins.

Submitting a Business & Team enquiry does not create a binding contract or guarantee pricing, availability, trial approval or supply.

Larger, customised or separately quoted orders may be subject to additional commercial terms agreed in writing before purchase.

Intellectual Property

All content on www.swimecho.com, including text, images, graphics, logos, videos and designs, is owned by or licensed to SwimEcho unless otherwise stated.

You may not reproduce, distribute, modify or commercially use our content without prior written permission.

Third-Party Services

Our website may use or link to third-party services, including payment providers, delivery companies and other service providers.

We are not responsible for the content, availability or independent actions of third-party websites or services.

Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

To the extent permitted by law, SwimEcho is not responsible for indirect or consequential loss arising from the use of our website, products or services.

We are not responsible for damage resulting from misuse of a product, failure to follow instructions or use outside the stated operating conditions.

We may update these Terms of Service from time to time. The latest version will be published on this page.

Governing Law

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer rights that may apply.
